						Chapter 1 General Rules

		Article 1 (Purpose)

This agreement is designed to stipulate the service terms and procedure of all the services provided by the ASEAN-Korea Centre Website (“services” hereinafter), the rights, the duties, the responsibilities and other necessary matters of the users and the Website.

		Article 2 (Agreement Validity and Amendment)

1. Provided that you agree to this agreement, it shall be applied preferentially to the Korea-ASEAN Website’s business of providing its services and your acts of using the services.
2. The Korean-ASEAN Website may revise this agreement without any advance notice. Any revisions to this agreement shall be notified to the users by publishing them on the Website or by e-mail. The revisions shall enter into force upon their notification. If a user disagrees to any of the revisions, the user may withdraw his or her membership registration. If a user continues using the Website, he or she shall be deemed to have agreed to the revisions

		Article 3 (Regulations and Rules Other than This Agreement)

1. Matters that are not specified in this agreement shall be regulated by the Framework Act of Telecommunications, the Telecommunications Business Act, the Regulations for Review by the Korea Internet Safety Commission, the Telecommunication Code of Conduct, the Computer Programs Protection Act, and/or other relevant statutory provisions. 
 
		Article 4 (Definition of Terms)

The terms used in this agreement are defined as follows:
1. User(s): One (those) who enjoys (enjoy) the services provided by the ASEAN-Korea Centre Website pursuant to this agreement;
2. Subscription: The act of entering information on the application form provided by the ASEAN-Korea Centre Website and completing this service agreement by agreeing to this agreement; 
3. Member(s): One (those) who is (are) authorized to use the services provided by the ASEAN-Korea Centre Website by registering as its member by providing personal identity information; 
4. Password: A combination of characters and numerals which the user selects to protect his or her privacy of communication by authenticating the user identity with his or her password; and
5. Withdrawal: The user’s act of terminating this service agreement.

		Chapter 2 Provision and Use of Services

		Article 5 (Formation of Service Agreement)
						
1. This service agreement is constituted and assumes full validity when the applicant completes the online subscription procedure by filling out the items required on the subscription form provided by the ASEAN-Korea Centre Website. 
2. The ASEAN-Korea Centre Website may revoke subscription to this service agreement in cases falling under any of the following: 
	1) Subscription made using another person’s name or identity; 
	2) Subscription made by providing false information on the application form for this service agreement; 
	3) Obstructing others from using the ASEAN-Korea Centre Website services or using the information by stealth; 
	4) Committing acts prohibited by the statutes or by this agreement while using the ASEAN-Korea Centre Website; or
	5) Failure to satisfy other requirements which the ASEAN-Korea Centre Website stipulates as conditions of subscription to its service. 

		Article 6 (Consent to Use of the Member’s Personal Information) 
						
1. The member’s personal information is protected by the laws on the protection of personal information by public entities.
2. The member’s personal information is used, maintained and protected by the ASEAN-Korea Centre Website as follows:  
	1) Use of personal information: The ASEAN-Korea Centre Website does not disclose or disseminate the member’s personal identity information collected in connection with its provision of its services to any third parties without the member’s prior approval. This shall not apply, however, to cases where a government agency requests the disclosure of such information pursuant to the relevant statutory provisions, including those under the Framework Act on Telecommunications, where it is requested for investigation of a crime or by the Telecommunication Ethics Commission, where a request is made pursuant to a procedure provided under other statutes, or where the user voluntarily discloses such personal information. 
	2) Maintenance of personal information: To protect or maintain the personal information, the user may revise or delete his or her personal information for the services as required. 
	3) Protection of personal information: Only the user may view, revise or delete his or her personal information, which is maintained by the user ID and password exclusively. Therefore, the user shall not disclose his ID or password to any third parties. The user always needs to log out whenever he or she exits from the Website. <br/>
3. The user shall be deemed to have consented to the collection or use of the member information indicated on his or her application form if he or she makes an application for subscription to the services offered pursuant to this agreement. 

		Article 7 (Security of User Information) 

1. The user shall be responsible for maintaining the confidentiality of his or her entered information from the moment when he or she completes the service subscription procedure for the ASEAN-Korea Centre Website. The user shall be responsible for all and any consequences arising from use of his or her ID and password. 
2. The user shall be exclusively responsible for the maintenance of his or her ID or password. The user shall report to the ASEAN-Korea Centre Website immediately upon discovering that his or her ID or password has been used illegitimately. The user shall be exclusively responsible for any losses or damages caused by his or her failure to report such illegitimate use. 
3. The user shall duly log out whenever he or she terminates his or her use of the ASEAN-Korea Centre Website services. The ASEAN-Korea Centre Website shall not be responsible for any damages or losses caused by a third party’s use of the user information enabled by the user’s failure to log out duly from the Website.

		Article 8 (Suspension of Services) 

1. The ASEAN-Korea Centre Website may arbitrarily limit or suspend its services if the user violates any of the provisions of this agreement. 

		Article 9 (Service Change or Termination) 

1. The ASEAN-Korea Centre Website shall not be responsible for any gains or losses which the user expects from his or her use of the Website services or for any gains or losses caused by the data the user obtains from the Website services. The ASEAN-Korea Centre Website shall not be responsible for the reliability or the accuracy of any information, data or other details the user publishes on the Website. 
2. The ASEAN-Korea Centre Website shall not be responsible for any damages caused to the subscriber by the subscriber’s own deliberate or negligent acts in connection with his or her use of the Website services. 

		Article 10 (Copyright of Published Articles)

1. The rights concerning any articles the subscriber publishes on the Website shall remain with him or her. 
2. The ASEAN-Korea Centre Website reserves the right to edit or move the details of its publications without advance notice and to delete them without advance notice according to the rules on the operation of its bulletin board.  
3. The user shall be exclusively responsible for any civil or criminal liabilities arising from infringement on the part of the user’s publications of copyrights belonging to third parties.  

		Chapter 3 Obligations and Responsibilities 

		Article 11 (Obligation of ASEAN-Korea Centre Website)

1. The ASEAN-Korea Centre Website shall not disclose or disseminate its members’ personal information to any third parties without obtaining the prior approval of the members. This shall not apply, however, to cases where such information is requested by government agencies pursuant to the relevant statutes, including those concerning telecommunication services. 

		Article 12 (Members’ Duties) 

1. The members shall provide the correct information as required for subscription. The members shall also maintain or update their information so that the Website may maintain it in the correct status. The members shall not allow any third parties to use their ID or password. 
2. The members shall not use the ASEAN-Korea Centre Website’s services for any types of acts involving the acquisition of profits without obtaining the prior approval of the Website.  

		Chapter 4 Miscellaneous 

		Article 13 (Prohibition of Assignment)

1. The members shall not assign or donate their rights to use the services or their position under this agreement to any third parties. 

		Article 14 (Compensation for Damages) 

1. The ASEAN-Korea Centre Website shall not be responsible for any damages caused to its members in connection with services provided to them free of charge, except for damages caused by any criminal acts committed intentionally by the Website. 

		Article 15 (Immunity)

1. The ASEAN-Korea Centre Website does not approve, oppose or revise any opinions expressed by its members or third parties. The ASEAN-Korea Centre Website shall not be responsible for any gains obtained by or damages inflicted on its members based on information included in the services.  
2. The ASEAN-Korea Centre Website shall not be responsible for the trading of goods or for financial transactions undertaken between its members or its members and third parties where its services are used as the media for such. The ASEAN-Korea Centre Website shall not be responsible for any gains its members expect in connection with their use of its services.

		Article 16 (Court of Jurisdiction)

1. The laws of the Republic of Korea shall apply to any disputes arising between the ASEAN-Korea Centre Website and its users concerning their use of its services. Any such disputes shall be referred to a competent court of law in the Republic of Korea. 

Addendum 1. (Enforcement Date) This agreement shall enter into force on 10 March 2009.
